SMS & Mobile Messaging Policy

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

Code Hamlet LLC may send automated SMS text messages to users who have explicitly opted in. These messages are limited to operational and compliance-related communications, such as:

  • Compliance alerts and regulatory deadline reminders.
  • License or certification expiration notifications.
  • Account security or authentication messages.

Message Frequency

Message frequency varies based on compliance events and account activity. You will not receive marketing or promotional SMS messages from Code Hamlet LLC.

Standard message and data rates may apply depending on your mobile carrier plan.

Opt-Out (STOP)

You may opt out of SMS communications at any time by replying STOP to any message you receive from us. After sending STOP, you will receive a single confirmation message and no further SMS messages will be sent to your number. To re-enable messages, contact us or update your notification settings in the employee portal.

SMS Opt-In Process — How Users Consent to SMS

Employees opt-in through the Code Hamlet secure employee portal. Upon login, users navigate to 'Notification Settings' where they can provide their mobile number. Users must check an optional, un-pre-selected box that states: 'I consent to receive automated compliance alerts and expiration reminders from Code Hamlet LLC at the number provided. Msg frequency varies. Msg & data rates may apply. Reply STOP to opt-out. [Link to Privacy Policy].' Submission is not conditional on receiving SMS.

Consent to receive SMS messages is entirely voluntary. Employees and portal users may use all features of the platform without providing a mobile number or consenting to SMS notifications. The checkbox for SMS consent is never pre-selected. Consent is recorded with a timestamp and is stored securely.

SMS opt-in data, including mobile numbers and consent records, is never shared with third parties for any purpose, including marketing, advertising, or data brokering.

Data Sharing & Disclosure

Code Hamlet LLC does not sell, trade, or rent your personal information to third parties. We may share information only in the following limited circumstances:

  • Service providers: We engage trusted third-party vendors (e.g., cloud hosting, SMS delivery) who process data on our behalf under strict contractual data protection obligations.
  • Legal requirements: We may disclose information if required by applicable law, court order, or government request, or to protect the rights, property, or safety of Code Hamlet LLC, our users, or the public.
  • Business transfers: In the event of a merger, acquisition, or asset sale, your information may be transferred. We will provide notice before your information is transferred or becomes subject to a different Privacy Policy.

SMS data specifically: Text messaging originator opt-in data and consent information is never shared with any third parties, including affiliates, for any purpose.

Data Retention

  • Account data: Retained for the duration of your account and for up to 3 years following account closure for audit and compliance purposes.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR OUR SERVICES SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO CODE HAMLET LLC IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitation may not apply to you in full.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Arizona, without regard to its conflict of law provisions.

Any dispute arising from these Terms or your use of our services shall be resolved through binding arbitration or in the courts of competent jurisdiction located in Arizona, and you consent to the personal jurisdiction of such courts.
